FDIC and OCC Proposed Rulemaking

Modernization of the Community Reinvestment Act

August 2018 the Office of the Comptroller of the Currency issued an advanced notice of proposed rulemaking (ANPR) inviting public comment on ways to update, change and modernize the Community Reinvestment Act Regulation. During the open comment period 1787 comments were submitted. Community-Up submitted a response, you can search it here.

January 2020, the Federal Deposit Insurance Corporation (FDIC) and the Office of the Comptroller of the Currency (OCC) filed a proposed rule change with the Federal Register. A summary of some of the most unspeakable proposed changes are listed below. Please see a summary of the proposed changes provided by the OCC here

The comment period is open until March 9, 2020. Please submit your comments by that time.

HUD Proposed Rulemaking

Affirmatively Furthering Fair Housing

HUD announced it’s proposed changes to the affirmatively further fair housing rule on January 16, 2020. You can read more about the proposed changes here.

I will try to sum up the entire process for you in a few sentences and I will provide you with a link to read the actual proposal submitted by HUD. 

Our government agencies have a process they must adhere to when they want to change or amend legislation that regulate our government.  As Secretary of HUD Carson has been making various changes to several laws that provide protection and fairness for protected classes (immigrant, disabled, minorities, women).  When agencies want to make a change they MUST submit their proposed changes to the Federal Register and allow for the public to review the changes and submit comments that support or object, and why.  The comment period usually lasts for 60 days. Then they take all the comments and review them and make a determination.  The more comments, the better, especially if they are to support protecting people and their rights.

The most recent is the proposed rulemaking changes to the Affirmatively Furthering Fair Housing rule that the Obama Administration clarified and offered additional guidance during his tenure.
